However, we would suggest that unwelcome as it was to many, the real damage was done by the recruitment markets' reaction to it, not the legislation itself. Since 2020, Kimson has been trying to undo some of that damage.

After all, you've probably got some great relationships with some fantastic umbrella companies and that's where 99% of your candidates will go. But what about the candidates who didn't apply for the role because it was Inside IR35 or because it was 'Umbrella Only'? We want to help you meet them and place them! And it could be a game changer.
Help Your Clients To Receive The Best Contractors
Kimson has been championing the use of Limited Company for many years and IR35 does not prevent their use whatsoever.
It's well known that contractors can use their Limited Company when they receive an Outside determination, but Deemed Employment is HMRC's structure for contractors using their Limited Company for Inside IR35 roles. Imagine how much easier it would be to source candidates, particularly those holding out for those all too elusive high rate Outside IR35 roles, if alongside umbrella payroll, you could advertise that the contractor can use their Limited Company if they wish.
It's a small change but, for all the clients and agencies already working with Kimson, they know the benefits it provides. Kimson specialises in speaking with your prospective candidates and helping them understand how taking your role and being paid into their Limited Company could be great for them.
Kimson Is The Reason You Should Revisit IR35
Many clients and some agencies believe that IR35 is a minefield. But with Kimson, it can reduce risk, make your life easier and improve your business. And with incoming legislation, it soon becomes perhaps the safest route to success.
The 4-Step Process
Step 1: The Determination
Your client needs to make a reasonable sign off on whether, based on the nature of the role and the working practices, it is Inside IR35 or Outside IR35. This produces the Status Determination Status (SDS). There are many businesses, including some brilliant TRN Partners, who can assist with this process.
Step 2: Pass The SDS Down The Supply Chain
Whoever holds the SDS is the Fee Payer. It is the Fee Payer who HMRC hold responsible for making the correct tax deductions. That's where Kimson comes in.
Step 3: Kimson As The Fee Payer
Once you have passed the SDS to Kimson, there are no further liabilities for your client or your business. Not only that, but when one of your candidates wants to understand what the benefits of using their Limited Company would be, just pass them to us. We'll do a deep dive with them and understand how using their Limited Company could work for them personally, converting possible candidates to definite candidates on your behalf.
Step 4: Pass The Funds
When it comes to processing pay, send the funds to Kimson just as you do with the umbrellas on your PSL. For Inside IR35, Kimson make the requisite deductions, submit the RTI to HMRC and pay the remaining funds into the contractors Limited Company. For Outside IR35, the funds will be paid gross.
